Resumen

The paper studied the parameters used by the International Court of Justice in the Silala water case between Chile and Bolivia. For this purpose, the principles of International Water Law were used, as well as those developed by this high court of justice with respect to international watercourses. The role played by international custom in the resolution of the controversy was determined, as well as the need for further development of the principles derived from international custom for similar cases in the future, all of which will allow for greater optimization and preservation of transboundary basins.
